AGREEMENT
In consideration of any of the above named Sellers or their related organization (hereinafter designated as the “seller”) extending credit to the above named applicant (hereinafter designated the “Buyer”), the undersigned individually and jointly severally, hereby guarantees to such Seller or its assigns the prompt payment at maturity, or any time thereafter, at Sellers option for all purchases hereafter made from the Seller to the Buyer, and if it becomes necessary to enforce this on the amount for which the undersigned agrees to pay the interest at the rate of 18% per annum after maturity until paid on the amount for which the undersigned is liable, and all costs plus 20% attorney’s fees and actual expense of collection. I hereby agree that “Maturity” shall not only mean the time when the payment is to become due, but at any time, if in the opinion of the Seller, the Buyer becomes financially unsound, then the obligation of the buyer to the Seller may be declared by the Seller to have Matured. The undersigned hereby agrees that this guarantee shall be directly enforceable against the undersigned without first resorting to the principal debtors or exhausting remedies against them. The undersigned further agrees that in the event that a settlement is made with the original debtors for less than the amount of the indebtedness actually due the Seller, the undersigned shall in no way be released from liability for the balance still due the Seller on said indebtedness even though said debtors shall have been released from said indebtedness. This an absolute and continuing guarantee.
